1. Definitions
- We: Badr Company Bouwbedrijf (trading as Badr Company), who carries out the work.
- You: the client. This can be a consumer (a private person not acting for a trade or business) or a business client.
- Work: the agreed work, such as plastering, drywall, tiling, flooring, painting, bathrooms and dormers.
2. Scope
These terms apply to every quote and every contract with Badr Company. Deviations only apply if we agree them with you in writing (email or WhatsApp also count). You receive these terms with the quote. They are also always on this page.
3. Quote and contract
- Our quote is valid for 30 days, unless the quote says otherwise.
- The quote states the work, the price per item, the materials, the schedule and whether the price is fixed or based on hours.
- The contract is formed when you accept the quote in writing, including by email or WhatsApp.
- Prices and estimates on the website and in the price calculator are indications. Only the quote is binding.
4. Prices
- For consumers we state prices including VAT. For business clients prices may exclude VAT. The quote will then say so clearly.
- We charge per m², per metre or per item, as stated in the quote. Small extra jobs are charged at € 50 per hour excluding VAT. Including VAT that is € 54.50 (9%, for plastering and painting in homes older than 2 years) or € 60.50 (21%, other work).
- Travel costs are included. Each job has a minimum charge: € 250 for plastering and painting, € 300 for drywall and flooring, € 400 for tiling (excl. VAT).
- Materials are listed separately in the quote.
5. Extra work and reduced work
We only carry out extra work after you have approved it in advance in writing, including by email or WhatsApp. You first get photos and a price. Work that is dropped is settled on the final invoice.
6. Execution
- We carry out the work properly and skilfully, according to the agreements and the applicable rules.
- The schedule in the quote is our best estimate. If there's a delay, we let you know as soon as possible and agree a new date.
- We cover what needs protecting, tidy up daily and leave the work broom-clean.
- If we bring in someone else for part of the work, we remain responsible for the whole job.
7. What we ask of you
- You make sure we can access the work at the agreed times and that water and electricity are available.
- You empty the room as much as possible, or agree with us that we do it.
- You arrange the permissions you need yourself, such as from your landlord, the owners' association (VvE) or an environmental permit. We're happy to help.
- You tell us what you know about pipes in walls and floors and about possible asbestos.
8. Asbestos and unforeseen situations
If we find material during the work that may contain asbestos, we stop at that spot immediately. Survey and removal are left to a certified company. Those costs are not part of our quote. If we find something else unexpected, such as rotten wood or old pipes, we consult you first (see article 5).
9. Handover
- When the work is finished, we go through it with you using a checklist.
- We note small snags and fix them within an agreed period. These are no reason to refuse the handover.
- If you are a consumer, you have the legal right at handover to deposit up to 5% of the contract price with a civil-law notary as security for repairing defects (article 7:768 of the Dutch Civil Code).
10. Payment
- For bigger jobs you pay in instalments, each after a completed stage. The instalments are in the quote. We don't ask for a large deposit up front.
- You pay the final instalment after handover.
- You pay within 14 days of the invoice date.
- If you don't pay on time, we first send a free reminder with a new 14-day period. Only after that can we charge statutory interest and collection costs as permitted by law.
- Materials not yet installed remain our property until they are paid for.
11. Warranty
- We give a 3-year warranty on our workmanship from handover. Defects caused by our work, such as cracks in plaster or joints, are repaired free of charge.
- The warranty does not cover damage from normal wear, misuse, movement of the substrate or building, or work changed by others.
- Materials carry the manufacturer's warranty. We help you with a claim.
- This warranty is in addition to your legal rights and does not limit them.
12. Liability
- We have business liability insurance. If our work causes damage to your home or belongings, it is covered.
- Towards business clients, our liability is limited to the amount our insurer pays out in that case, or, if it doesn't pay, to the amount of the job. Towards business clients we are not liable for indirect damage, such as lost profit.
- Towards consumers we do not limit our legal liability.
- These limitations do not apply in case of intent or gross negligence.
13. Cooling-off period (right of withdrawal) for consumers
If you are a consumer and conclude the contract with us outside our business premises, for example at your home, or at a distance, such as by email or WhatsApp, you have a 14-day cooling-off period. It starts the day after the contract is concluded. During that time you can cancel the contract without giving a reason.
- You cancel by telling us clearly, by email to Badrkomp@gmail.com or by letter. You can use the model form below, but you don't have to.
- If you want us to start within the cooling-off period, we ask you to request this explicitly. If you then cancel anyway, you only pay for the part of the work already done.
- If, with your explicit consent, the work is fully completed within the cooling-off period and you have confirmed that you waive the cooling-off period, the cooling-off period no longer applies.
- There is no cooling-off period if you ask us to come for urgent repairs or urgent maintenance.
Model withdrawal form
I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the provision of the following service (*):
……………………………………
Concluded on (*): ………………
Name of consumer(s): ………………
Address of consumer(s): ………………
Signature of consumer(s) (only if this form is submitted on paper): ………………
Date: ………………
(*) Delete as appropriate.
14. Cancellation
If you want to cancel the job after the cooling-off period, or if no cooling-off period applies, let us know as soon as possible. You then pay for the work already done and the costs we have already incurred, such as materials ordered specially for you. For consumers the rules of the law also apply.
15. Complaints
Not happy with something? Let us know as soon as possible after you notice it, preferably with photos, by email or WhatsApp. We reply within 5 working days and work with you to find a solution. A complaint only suspends your payment for the part of the work the complaint is about.
16. Applicable law and disputes
Our contracts are governed by Dutch law. If we can't resolve a dispute together, it can be brought before the competent court. If you are a consumer, you always keep the rights the law gives you, including bringing the case before the court where you live.
